Referral Program Terms
Effective: May 23, 2026 · Oettinger Management Group / We Buy Doublewides ("Company")
These terms govern the $1,000 referral payment offered through our Referral Program. By submitting a referral via our referral form, you agree to these terms. Read them before submitting.
1. Eligibility
You may submit a referral if all of the following are true:
- You are 18 or older and a resident of the United States.
- You are not a licensed real estate agent or broker offering brokerage services on the property being referred (referral fees to licensed brokers are governed separately by state real estate law).
- You have the seller's express permission to share their contact information with us.
- You are not yourself the seller, a co-owner of the property, or a member of the seller's immediate household.
- You are not currently employed by Oettinger Management Group, We Buy Doublewides, or any affiliated entity.
2. Qualified Referral
A "qualified referral" means a property that meets ALL of the following:
- Manufactured home, mobile home, doublewide, singlewide, or similar factory-built home on land owned by the seller, OR vacant land or a stick-built house meeting our buying criteria.
- Located within our service area (50-mile radius from Sellersburg, Indiana, including Southern Indiana and Northern Kentucky).
- Not a property in a mobile-home park or on rented/leased land.
- Not previously submitted to us by another referrer or contacted by us before your submission.
- Not already under contract or pending sale with another buyer.
3. When the Referral Fee Is Earned
The $1,000 referral fee is earned and payable only when ALL of the following occur:
- Your referral submission is the first and only valid submission for that property (we use submission date/time and prior contact records to determine "first").
- We make an offer, the seller accepts that offer, and the transaction closes with funds transferring and the deed/title recorded in our name.
- You have provided a completed IRS Form W-9 to us prior to payment (referral fees of $600 or more in a calendar year are reportable to the IRS on Form 1099-NEC; we will not issue payment without a W-9 on file).
- The closing occurs within 12 months of your referral submission. Submissions older than 12 months are not eligible even if a closing eventually occurs.
4. When the Referral Fee Is NOT Paid
- The seller did not give you permission to share their contact information.
- The property does not meet our buying criteria.
- The seller was already in our system or under prior contact when you submitted.
- Another referrer submitted the same property before you did.
- The deal fails to close for any reason (seller backs out, title cannot be cleared within a reasonable timeframe, financing payoffs exceed property value, etc.).
- The seller refuses to engage with us or does not respond after our initial outreach.
- You are a licensed real estate broker or agent and the referral relates to a property where you owe a fiduciary duty.
- You do not provide a completed W-9.
5. Payment Timing & Method
Qualified referral fees are paid within 30 days of the closing date, by check mailed to the address you provided on the W-9, or by ACH if you prefer (request ACH in writing). We do not pay cash and do not pay in advance of closing.
6. Tax Reporting
Referral fees are taxable income. We will issue an IRS Form 1099-NEC for any calendar year in which you receive $600 or more in total referral payments. You are responsible for all federal, state, and local taxes on referral payments. We do not provide tax advice; consult a tax professional if needed.
7. No Agency, No Brokerage
The Referral Program does not create any agency, partnership, joint venture, employment, or brokerage relationship between you and Company. You are not authorized to make representations on Company's behalf, negotiate price, sign documents, or hold yourself out as an agent or representative of Company.
The referral fee is paid solely for the act of providing the seller's contact information with permission. It is not compensation for real estate brokerage services. If you are providing services that constitute real estate brokerage under applicable state law, those services must be governed by a separate written agreement and you must be appropriately licensed.
8. Use of Seller Information
Information you submit about a seller is used solely to evaluate and (if applicable) purchase the property. We do not sell or share referred seller contact information with third-party investors, lead brokers, or marketing networks.
9. Disputes & Disqualification
Company is the sole arbiter of whether a referral qualifies for payment. Disputes about eligibility, duplicate submissions, qualifying status, or timing of contact will be resolved by Company in good faith based on our internal records.
We may disqualify any referrer who: (a) submits sellers without permission; (b) submits fraudulent, fictitious, or low-quality leads in bulk; (c) attempts to manipulate the program; (d) violates any of these terms. Disqualification forfeits any pending referral payments.
10. Modification & Termination
We may modify these terms or terminate the Referral Program at any time, with or without notice. Changes apply to referrals submitted on or after the effective date of the change. Referrals submitted before a change are governed by the terms in effect at the time of submission.
11. SMS & Contact Consent
When you submit a referral form, you authorize us to contact you (the referrer) by phone, text, or email regarding the referral and future referrals. You may opt out at any time by replying STOP to any text or emailing us. Message and data rates may apply.
12. Limitation of Liability
To the maximum extent permitted by law, Company's total liability under the Referral Program is limited to the amount of any qualified referral fee earned but unpaid. Company is not liable for indirect, incidental, consequential, or punitive damages.
13. Governing Law
These terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Any dispute arising from the Referral Program shall be resolved in the state or federal courts located in Clark County, Indiana.
